We collect data to facilitate the "License to Access" granted in our Terms and Conditions and to power the proprietary algorithms of the K.O.S. ecosystem.

  • Profile Data: Your username, password, membership tier (Founder, Regent, Monarch), and feedback regarding "Style Polls."

1.2. Automated Data Collection (The App & Algorithms):

When you use the App or interact with the Royal Credit system, we automatically collect data that feeds our proprietary mechanics:

  • Usage Data: Time spent in-app, game scores, features used, and interaction patterns.

  • Device Data: IP address, device type, operating system, unique device identifiers (UDID), and mobile network information.

  • Location Data: General location data (city/state) derived from IP addresses for shipping and analytics.

2. HOW WE USE YOUR INFORMATION

We use your data not just to fulfill orders, but to operate the specific mechanics of the K.O.S. Brand.

2.1. Operational & Fulfillment:

2.2. "Royal Credit" Algorithm & Gamification:

Critical: You acknowledge that your Usage Data is utilized to calculate "Royal Credits." We use this data to:

  • Feed the proprietary algorithms that determine RC rewards.

  • Analyze user behavior to adjust game difficulty and reward distribution.

  • Prevent fraud or manipulation of the RC system (e.g., detecting bot-like behavior).

2.3. Marketing & Community:

  • To manage "Design Votes" or "Style Polls."

  • To send marketing communications (which you can opt-out of).

3. DATA OWNERSHIP & INTELLECTUAL PROPERTY

While you retain rights to your specific Personal Information (like your name), K.O.S. BRAND NYC retains exclusive ownership of all aggregated Usage Data and the resulting algorithmic insights.

  • No Claim to Algorithms: You acknowledge that the data generated by your gameplay (scores, RC accumulation rates) contributes to our Trade Secrets. You have no intellectual property claim over the data patterns or the "Royal Credit" logic generated by your usage.​

 

4. SHARING YOUR INFORMATION

We do not sell your Personal Information to third parties for money. We share data strictly to operate our business:

4.1. Service Providers:

We may share data with third-party vendors who perform services on our behalf, such as:

  • Payment processing.

  • Data analysis and email delivery.

  • Hosting services and customer service.

  • Logistics: Sharing addresses with shipping carriers.

4.2. Legal Obligations & Safety:

We may disclose information if required to do so by law or in the good-faith belief that such action is necessary to:

  • Prevent fraud or investigate potential violations of our Terms and Conditions.

 

5. DATA SECURITY & LIABILITY LIMITATION

5.1. Security Measures:

We use commercially reasonable administrative, technical, and physical security measures to help protect your personal information.

5.2. No Guarantee:

No data transmission over the Internet or wireless network can be guaranteed to be 100% secure. You acknowledge that there are security and privacy limitations inherent to the Internet which are beyond our control.

5.3. Limitation of Liability:

K.O.S. BRAND NYC  shall not be responsible or liable for any unauthorized access to, alteration of, or use of your account or data arising from a third-party hack, data breach, or system failure, provided we have not acted with gross negligence.

6. CHILDREN'S PRIVACY (COPPA)

Our Services are not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verification of parental consent, we will delete that information.

7. YOUR RIGHTS (CALIFORNIA & OTHERS)

Depending on your jurisdiction (such as California under CCPA/CPRA), you may have specific rights:

  • Right to Delete: You may request that we delete your personal information, subject to certain exceptions (e.g., we must retain transaction records for tax purposes).

  • Non-Discrimination: We will not discriminate against you for exercising these rights. However, deleting your data may result in the forfeiture of all Royal Credits and termination of your Membership, as the account cannot exist without the underlying data.

Our App or Site may contain links to third-party websites. We are not responsible for the privacy practices or content of these third-party sites. Once you leave our ecosystem, this Policy no longer governs.

 

9. GOVERNING LAW

This Privacy Policy and any disputes related thereto shall be governed by and construed in accordance with the laws of the State of New York, exclusive of its choice of law rules.

 

10. CHANGES TO THIS POLICY

We reserve the right to modify this Privacy Policy at any time. If we make material changes, we will notify you by updating the date at the top of this policy or through a notification in the App. Your continued use of the Service after any changes indicates your acceptance of the new Privacy Policy.
